Firm Wins Dismissal of Fraudulent Conveyance Claims
May 2020 - KSR secured the dismissal of fraudulent conveyance claims asserted against its clients. The plaintiff, a services provider, brought breach of contract and other claims against a healthcare company for failure to pay for its services. The plaintiff also sued a group of individuals and entities related to the company, claiming that they improperly diverted company funds for their own benefit. The plaintiff brought fraudulent conveyance, breach of fiduciary duty, and unjust enrichment claims against them.
KSR, which represented a number of the individuals and entities, prevailed on its motion to dismiss all of the claims against all of their clients. KSR also prevailed in dismissing a counterclaim for indemnification and contribution. Howard Rosenburg and Ashley Fawver handled the case.
