KSR Obtains Complete Dismissal Before CFTC
October 2022 – KSR obtained a complete defense victory for its clients in a breach of fiduciary duty case involving futures trading. A Commodity Futures Trading Commission Administrative Judge granted KSR’s motion for summary disposition and dismissed a Complaint brought by a customer against KSR’s clients, a futures commission merchant and an introducing broker. The Complaint alleged that KSR’s clients breached their fiduciary duty and violated a CFTC regulation in their handling of the customer’s futures trading account which, the Complaint alleged, caused the customer significant losses. In granting the Motion for Summary Disposition, the CFTC Administrative Judge dismissed the customer’s Complaint against all Respondents as to all counts.
